General Terms and Conditions
§1 Scope
(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers and businesses through the 3D printing service of mechatronic factory GmbH.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a legally recognized partnership that, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.
(3) These GTC shall also apply to future business relationships with entrepreneurs, without the need for mechatronic factory GmbH to refer to them again. The use of conflicting or supplementary GTC by the entrepreneur is hereby rejected; they will only become part of the contract if mechatronic factory GmbH has expressly agreed to them.
Hereinafter, the consumer or entrepreneur is referred to as the “customer.”
§2 Ordering Process
(1) The customer has the option to create an individual offer using the online 3D printing configurator of mechatronic factory GmbH. The configurator allows the customer to upload and adjust the desired parameters and file formats (STL, STEP, IGES, 3MF).
(2) After completing the configuration, the customer receives a non-binding offer, which is displayed immediately after creation. The customer can choose to accept the offer immediately through direct payment or order it on account.
(3) If the customer chooses to pay immediately, they can do so using the payment methods offered directly in the online configurator. Alternatively, the customer can choose the “Payment on Invoice” option. In this case, the invoice will be sent to the email address provided by the customer after order confirmation.
(4) The order is finalized as soon as the customer confirms the offer using one of the two mentioned payment options. An order confirmation and the invoice will be sent to the customer via email immediately after completing the order process.
(5) If the customer does not make the payment within seven days of receiving the invoice, they will be notified of the payment default in writing and granted an additional seven days to make the payment. If no payment is made within this period, the order will be canceled, and the offer will no longer be valid.
(6) mechatronic factory GmbH sends cost estimates, offers, and invoices exclusively by email. Shipping in paper form is not provided.
§3 Prices
(1) Prices are calculated individually, depending on the respective printing time of the customer’s order or the 3D model to be printed.
(2) Prices for creating and modifying 3D models are calculated based on the time required for this purpose. The time needed for creating and modifying the 3D model(s) depends on the complexity of the customer’s request.
(3) All current prices are listed on the website. mechatronic factory GmbH reserves the right to change the listed prices for 3D printing and for the creation and modification of 3D models at any time.
§4 Contractual Partner & Conclusion of Contract
The purchase contract is concluded between the customer and mechatronic factory GmbH. By sending a written order confirmation via email, the customer submits a binding order for the discussed 3D print. The order confirmation is sent within two business days of receiving the order confirmation. The customer receives this via email, along with the invoice and payment information from mechatronic factory GmbH.
§5 Payment
The customer generally has the option to pay in advance or via PayPal. Both payment methods are offered directly in the order confirmation email.
Advance Payment: For advance payment, the customer transfers the invoiced amount within seven days to the bank account of mechatronic factory GmbH provided in the order confirmation email or on the invoice.
PayPal: For payment via PayPal, the customer pays the invoiced amount within seven days via the link provided in the order confirmation email. During the ordering process, the customer is redirected to the PayPal website, where they can enter their login details and confirm the payment instruction to PayPal. The payment transaction is then carried out automatically by PayPal immediately afterward. The purchase contract is thus concluded.
(To pay the invoice amount via PayPal, the customer must be registered with PayPal or register first, authenticate with their login details, and confirm the payment instruction to mechatronic factory GmbH.)
§6 Payment Default
If no payment is received from the customer within seven days, they will be notified in writing of their payment default and granted a further seven days to make the payment. After this period, the confirmed offer is no longer valid, and the purchase contract is void.
§7 Cancellation
(1) The customer may cancel the order as long as the 3D printing process has not yet begun. However, the start of the 3D printing process depends on the current order situation and capacity utilization.
(2) To cancel an order, the customer must send an email to print-factory@mechatronic-factory.com. They will then receive a prompt response via email as to whether cancellation is still possible.
(3) If the cancellation is successful, the customer will be refunded the paid invoice amount within seven days, depending on the selected payment method, to the bank account or PayPal account from which the payment was made.
(4) Cancellation due to late delivery is only possible if the delivery is delayed by more than 14 days beyond the expected delivery date.
(5) mechatronic factory GmbH ensures a coarse to fine post-processing of the 3D print; however, minor residues may still remain. This is not a reason for cancellation for the end consumer.
(6) Cancellation of a monthly subscription for 3D printing is possible at any time outside the specified minimum term. Returns within 14 days of purchase are also possible, but the monthly fee must not have been used.
§8 Delivery Conditions
(1) In addition to the stated product prices, shipping costs may apply. The exact amount of shipping costs depends on the customer’s order and is included in the offer.
(2) Depending on the order size, shipping is carried out by Deutsche Post, DHL, or Hermes. In exceptional cases, an alternative transport company (UPS, DPD) may be used. For shipments by freight forwarding, delivery is made to the curbside or the first lockable door.
(3) Delivery is made to the delivery address specified by the customer.
(4) Delivery dates and deadlines are only binding if they have been confirmed in writing. If the delivery date for the express service is exceeded, the fees will be automatically canceled, and the delivery will be carried out as a standard delivery.
(5) In the 3D printing service, a delivery date cannot be guaranteed; it is only an estimate. The express service also does not guarantee a delivery date but is also considered an estimate.
(6) If the goods cannot be delivered to the specified delivery address, the customer bears the costs for return and reshipping. mechatronic factory GmbH is not obliged to store the 3D print for the customer unless the customer is not responsible for the delivery obstacle. mechatronic factory GmbH is entitled to destroy or otherwise dispose of the delivery after verifying the correctness of the shipment, notifying the customer, and allowing a reasonable period for collection. The remuneration claim of mechatronic factory GmbH remains unaffected unless the delivery can be otherwise disposed of. Temporary storage is at the customer’s risk.
§9 Transport Damage & Transfer of Risk
(1) Delivery is carried out at the customer’s risk according to §447 BGB. The risk of accidental loss or damage to the goods passes to the customer upon handover to the carrier or the transport person, with the beginning of the loading process being decisive. This applies regardless of who bears the shipping costs.
